These Terms govern your access to and use of the Service, including any AI features, content, updates, or enhancements. "AI Features" refers to software, algorithms, models, and outputs that analyze pet data to provide insights, trends, or recommendations. "User Content" is any data, text, images, videos, or materials you upload. "Service" is the BarkLens apps, website, and related features.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. Create an account with accurate information. You are responsible for maintaining confidentiality and all activities under your account. We reserve the right to refuse, suspend, or terminate accounts at our sole discretion.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not modify, reverse-engineer, decompile, or create derivative works from the Service; use it for commercial purposes without our written consent; remove proprietary notices; or circumvent security measures.
You agree to use the Service lawfully. Prohibited activities include uploading harmful or illegal content, harassment, attempting to hack or reverse-engineer security features, misrepresenting AI insights as veterinary advice, sharing pet data without the owner's consent, and using automated tools to scrape data.
All content, features, and functionality of the Service are owned by Think Tanc LLC. You retain ownership of your User Content but grant us a non-exclusive license to use, process, and display it to provide the Service. AI-generated outputs are provided for informational purposes and do not constitute medical advice.
Some features may require payment. Payments are processed via third-party providers (e.g., Stripe). Subscriptions auto-renew unless canceled before the renewal date. No refunds for partial periods except as required by law. We may suspend access for non-payment.
The Service provides educational insights and general information only. It is not a substitute for professional veterinary care, diagnosis, or treatment. AI outputs may contain errors or inaccuracies. Always consult a licensed veterinarian. We disclaim all warranties, express or implied. The Service is provided "as is" and "as available."
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from the Service. Our total liability shall not exceed the amount you paid us in the last 12 months (or $100 if no payments). This does not apply to gross negligence, willful misconduct, or death/personal injury where prohibited by law.
You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your User Content, violation of these Terms, infringement of third-party rights, or any pet health outcomes related to the Service.
You may terminate your account anytime via app settings or by emailing support@barklens.com. We may suspend or terminate your access for violations, non-payment, or suspected fraud. Upon termination, your license ends and we may delete your data subject to our Privacy Policy retention terms.
These Terms are governed by Delaware law. Disputes shall be resolved through binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association. You waive any right to a jury trial or class action participation. If arbitration is unenforceable, disputes shall be litigated exclusively in Delaware courts.
We may modify these Terms at any time. Material changes will be notified via email or in-app notice. Continued use after the effective date constitutes acceptance.
Severability: If any provision is invalid, the rest remains enforceable. Waiver: No waiver of a breach is a waiver of future breaches. Assignment: You may not assign these Terms without our consent. Entire Agreement: This is the complete understanding between us, superseding prior agreements. Force Majeure: We are not liable for delays due to events beyond our control.
